We do hope that you are reading this privacy statement because you visit our website or use our Komori Europe App. If this is true, then this privacy statement is about your personal data you share with us. We might also use the wordings “data” instead of “personal data” if we mean your personal data. According to the definitions in law (the General Data Protection Regulation, EU/2016/679), you are in this situation a so called “data subject”.
What is personal data?
Personal data is in fact all information which relates or can be related to you. All information about you, your behaviour, your preferences or just information which makes it understandable for other people that the information concerns you.
What data do we collect?
If and when you visit our website or use our Komori Europe App, we receive data about you. This privacy statement explains to you what the scope of this data is and how we use this. Not all data are personal data, but we think it is important for you to understand what data we can collect about you. Therefore, we provide you with a total overview of all data we collect.

If and when you visit our website or use our Komori Europe App on your mobile device, please note that your mobile device might share data with us. You can easily switch this off. In your settings or in your browser settings, you can choose which data is shared with us.
What do we do with your data? (the purposes of use)
We are collecting your data with a reason. We do collect your data to do the following:
The data you provide in the request for parts is used to contact you. One of our Komori agents will contact you to discuss the further details of your order as well as the envisaged delivery. Your data will thus also be used to make the delivery.
We are of course very curious on the usability of the app. Is it really as fun and easy as we had in mind designing it? We therefor use your data in a program/application run by AppMachine. This program helps us to see how often our app is used, on which dates and times, on which locations and for how long.
What is the legal basis for the use of your data? (the legal basis)
One of the basic rules in data protection law is that we can only use your data if we can rely upon a legal basis for processing. We use your data based upon the following legal basis:
When we use your consent, you have the right to withdraw this consent any time. When we use legitimate interest our interest consists of marketing interest in order to increase our sales.
Do you have concerns or questions regarding our use of your data?
You may request us (see our contact details mention above) which data we process on you. According to the law and its limitations, we will provide you with a detailed answer. You also have the right of correction or deletion of your data. You can manage this in the settings or browser of your mobile device. If we obtain your consent, you are allowed to withdraw this any time. This however does not influence the use of your data prior to this withdrawal.
You also have the right to object against the use of your data for marketing purposes. We however shall not use your data in such way. You can also request us to provide your data to a third party in a machine readable and interoperable format. For example, to re-use your data with another provider. We cannot think of how this works and why you should request us to do so. However, it’s in law, so we inform you and we shall take your request seriously. Please let us know when you want to exercise one of your rights. If you think that we unlawfully process your data, than we kindly request you to tell us, or you can also file a complaint at the Dutch Data Protection Authority in The Hague.
Do we share your data?
Yes, we do. We did not build the website/app ourselves. Also, the support and maintenance of the website/app is not done by us. We have assistance of two companies who therefor, and solely for this purpose, also process your data. These companies are AppMachine B.V. who markets and operates the website and Komori Europe App and an ict-company taking care of hosting and backups. Both companies follow our instructions. We have entered into a processor agreement with these companies. Only when obliged to do so, we will provide your data to authorities, other parties, persons or supervisory bodies.
Personal data might be transferred to parties established in countries outside the EER (Europe, Liechtenstein, Norway and Iceland). As far as we know, we are not doing this now. The GDPR considers data transfer within the EER acceptable. Transfer to most countries outside the EER is considered to be unsafe, with respect to your data protection rights. In case we do transfer your data to a country outside the EER, then we will take additional measures, such as entering into an additional agreement with such party to ensure an adequate level of data protection for you.
Are your data protected by us?
Data security is important, so we think. We have therefore taken several adequate technical and organisational measures to protect your personal data against loss or unlawful processing. This might sound undefined, but it means that we have restricted the access to the systems where your data is stored, and we do not share your data.
