Who are you? (the data subject)
We hope that you are reading this privacy statement because you are or will become our customer, you’ve been visiting our website, or have used the Komori Europe app. According to the legal definition set out by EU regulations, General Data Protection Regulation (GDPR) EU/2016/679, you are what is known as the “data subject”. This privacy statement refers to personal data that you share with us. In this policy, we may also use the word “data” to mean your personal data.

What is personal data?
Personal data is any information that relates to or can be used to identify you. It includes personal information about you, contact information, your preferences, your behaviours, or just details that make it clear to others that the information concerns you.

What data do we collect?
When you contact us with respect to our products or service, visit our website or use the Komori Europe app, we receive data that is unique to you. This privacy statement explains the extent of this data and how we use this. Not all data is personal data, but we believe it’s important for you to understand what information we can collect about you. Although we don’t currently collect extensive data about our users and visitors, we want to make sure that in the future you are informed about the potential data we could access. Visiting our website in general
Our website has plugins for social media, which you can see on the bottom left of the page. Using these buttons allows these social media platforms to collect your data through cookies placed on your device. We encourage you to refer to the individual platforms to find out more about their own privacy policies regarding your data.
Spare parts information request
In order to make some of our services available to you, we require certain information about you. When using the contact form, you provide us with the following:
 
• Your name
• Company name
• Contact information, including your email address
 
Using the Komori Europe app
Like most apps, the Komori Europe app gathers and processes automatically generated information about how you use it. The information includes your IP address or your unique device ID.

If you opt in, the Komori Europe app may also collect your geo-location. Our access to this can be changed at any point through your mobile device’s settings.

If you opt in to permit access and the collection of information from your social network account, then your basic personal information on your social network account will be collected, such as your name and email address, as well as your social network user ID. It does not collect your password information. We encourage you to refer to the social network’s policy for more information on how you can set the privacy preferences of your account. This will you help control the information that may be accessed and retrieved by these platforms.

Data collection also occurs regarding how you use the Komori Europe app. This helps us to understand how the app is being used and offers us insight into what we can do to improve the user experience and functionality. When using the Komori Europe app, the following information is collected anonymously:

• When you’ve opened the app
• The tabs you’ve opened inside the app and the amount of time you spent there
• Certain actions you take within the app
 
If you contact us about our products and services

We collect the following data:

• Your name
• Company name
• Contact information, including your email address
• The products and services which you are interested in or have in use
 
If you use the contact form on this page, we do collect the data provided by you when completing this form.
 
If you call, email or write us
We collect the data you share during these interactions. When you visit the Komori Europe website or use the Komori Europe app on your mobile device, your device may share data with us. You can manage this yourself by switching it off in your phone or browser settings. You can also specify what data is shared with us, as well as withdraw permission at any time.

What do we do with your data?
When we collect data, it is to achieve a specific purpose. Our reasons include the following:

1. To contact you as per your request
The data you provide when you submit a request for parts is used to contact you. One of our Komori agents will get in touch to discuss the details of your order, as well as the delivery date. Your data will also be used to make the delivery.

2. To analyse the use of the app and to gain insight into its usability
We aim to continuously improve the functionality of the app, specifically the user experience and design. We use your data in an application run by AppMachine, which lets us see how often our app is used, on which dates and times, at which locations, and for how long.

3. To use in our CRM system
We store data of customers and potential future customers in our CRM system. This CRM system is also used to send information about our products or service to you.

What is the legal basis for the use of your data?
One of the tenets of data protection law is that we only use your data if we can rely upon a legal basis for processing it. We use your data based upon the legal bases:

• In the performance of a contract with you
• Based upon your consent
• Based upon a legitimate interest
 
When we base our data collection on a legitimate interest, this refers to marketing efforts  in order to improve sales.
 
Once you have given us data permission, it’s important to note to that you have the right to withdraw it at any time.
 
Do you have concerns or questions regarding our use of your data?
This privacy policy is about our use of your data. However, you also have certain rights over the use of your data. You have the right to request access, correction, deletion, the right to be forgotten, the restriction of use of your data, the right of data portability and the right to object against the use of your data.

You may request details on what data we process on you at any time. In accordance with European legal requirements regarding privacy, we are obligated to provide you with a detailed answer. You may also request we correct or delete your data. For the Komori Europe app, you can manage this yourself in your mobile device settings. Although you are allowed to withdraw your permissions at any time, this does not have an effect on the use of your data prior to consent withdrawal.
 
You have the right to object against the use of your data for marketing purposes. You can also request your data to be given to a third party in a machine readable and interoperable format, such as when using your data with another provider.
If you think that we have unlawfully processed your data, than we kindly request you inform us. You can also file a complaint at the Dutch Data Protection Authority in the Hague, the Netherlands.

Do we share your data?
Sometimes it is necessary for us to allow third parties access to your data, such as the companies who offer the support and maintenance of our app and website. We have entered into a processor agreement with these companies to ensure the security of your data. Only when we are legally obliged to do so will we provide your data to relevant authorities, other parties, persons or supervisory bodies.
 
Personal data might also be transferred to parties in countries outside the EER (Europe, Liechtenstein, Norway and Iceland). The GDPR refers specifically to data that is transferred within the EER. In cases where we do transfer your data to a country outside the EER, such as when we need to refer you to a local distributor, then we make sure we have additional agreements in place that ensure an adequate level of data protection for you. 

If your personal data is stored in our CRM system it is exclusively processed for the purposes referred to above and will only be shared on a strict need to know basis with any company that is member of our group of companies, which includes our ultimate parent company Komori Corporation, where necessary for internal administrative purposes, corporate strategy, auditing and monitoring, sanctions screening and research and development. We might also share your personal data with our group companies where they provide products and services to us that help us to provide products and services to you as our customer.
 
Is your data protected by us?
Data security is important important. This is why we’ve taken several technical and organisational measures to protect your personal data against loss or unlawful processing. We have restricted the access to the systems where your data is stored and we do not share your data unlawfully.

How long do we use your data?
As long as you make your data available to us, we can access and process it. We store your data as long as needed for the purposes of use, although our access to your data can be withdrawn at any point.

Changes and updates to this policy
We may update our services to you, resulting in an amended version of this privacy policy. If these amendments are severe or greatly effect your data protection rights or the consent provided, then we will make our best effort to inform you in a timely manner. You can always check to see whether you have read the most recent version of the privacy policy on the date mentioned below.
